eBay Dodges L’Oreal’s Punch But Braces For Round Two From Tiffany

Belgian Court Clears eBay

The Belgian Court yesterday dismissed all charges filed by L’Oreal alleging eBay allowed the sale of counterfeit L’Oreal products on the eBay site. While this appears to be the second cout case in recent weeks that has been adjudicated in eBay’s favor, both L’Oreal and now Tiffany’s have announced they will appeal the rulings.

Continuing to Nibble Away at the 800 lbs Gorilla

eBay has been facing several legal attacks over the past several years, and though none of these battles seems to have crippled the online giant legally or financially, certainly they have spent a significant amount of money defending themselves. While some legal action is considered normal with a company the size of eBay, one has to wonder how long they can continue to wage the battle over the sale of counterfeit items.

Who is Really The Criminal

In my mind the sellers offering counterfeit items for sale are the criminals. If Tiffany and L’Oreal can prove that counterfeit items are being sold, why do they not prosecute the sellers? Even if eBay removed the suspected counterfeit items, these sellers would simply move to another venue. It is up to the owners of the trademark to prosecute the sellers. 

eBay Wins Fight In US Court vs Tiffany & Co.

Reuters is reporting that a US Federal Court Judge has today ruled in eBay’s favor in it’s fight with Tiffany & Co., regarding Tiffany’s claim of fake Tiffany items on the auction site.

Though this is a major victory for eBay, the auction giant is still reviewing it’s options in the recent French court ruling  involving LVMH the parent company of Louis Vitton and other name brand products.

eBay is working hard to prevent fake items on the site, but some feel not enough is being done, and want the auction site to police the items listed by members more diligently!
